Judge Refuses to Dismiss Gay Marriage Ban Lawsuit. From SeaChanges and SignOnSanDiego, an old client of mine.

Judge Walker repeatedly pressed the defendants to explain exactly *how* heterosexual marriage was harmed by the existence of homosexual marriage.
Unfortunately, defending counsel didn't know. And said so. As in "I don't know." (A direct quote.)

I'm all for this. If the defense does manage to present even a semi-solid case of how my non-traditional marriage threatens their traditional marriages, then I'll stop assuming that they're all a bunch of whiny fucks who want others to be miserable. (There *is* a threat to their marriages, in that if non-traditional marriages become mainstream, then some of the people who have been browbeaten into traditional marriages for fear of being labeled abnormal or freakish might just jump ship and do what makes them happy. However, "some of our folks might do what makes them happy instead of what we want them to do" is not what I'd call a valid excuse.)

Somehow, I suspect that's not how it's going to go down, though. :-)

I wonder if they think non-traditional marriages will cause traditional marriages to fail? Oh, wait, traditional marriages fail all the time.

In fact, that was one of our comments on the Louisiana judge and his interracial recusement. We refuse to marry straight people because their marriages, in our experience, fail so often. But we love straight married folks--we let them use our bathrooms.
