This just in from rightkindofme, according to a St. Louis jury, going to a bar and dancing is providing implied consent to be assaulted, to be publically exposed, to be filmed and included on a commercial DVD without signing a release.

Words cannot describe what I'm feeling right now. I think perhaps only stabbing can.

If the girl's lawyer is less than competent (or Joe Francis', more likely, is extremely expensive and competent), it wouldn't have been hard to stack the jury with misogynist jerks (especially in the Midwest, har de har). Frankly, I'm amazed this wasn't put up for summary judgment, but I don't know the intricacies of the system so I'm not sure if there'd be a disqualification for such involved.

What gives me some hope is that the article doesn't say anything about the judge's verdict, just the jury's; judges can and do overturn jury verdicts when they're beyond the pale like this. And even if the judge is equally misogynist, as you say, there's always appeal in what's likely to be a far less conservative background.

Well, only in MA and IL (and in IL, they explicitly made it illegal, MA just has no reasonable expectation of privacy exception (and yet, you have no expectation of privacy with anything you say to them)).

There is a bill in congress to change that nation wide.

Anywhere else, you can win a false arrest judgement.

Joe Francis is famous for being a scum-bag par excellence.

I think what you've got here is a case of a really good shyster (hired by Francis) and not-so good lawyer (hired by the lady) with a dumber-than-your-average-bear jury.

Hopefully the judge or appellate court will overturn this.
