This afternoon, the court ruled Proposition Eight unconstitutional*. I'm not exactly a romantic, but I'm all verklempt anyway. The marriages can't get started again yet, as the judge put a stay on the injunction for now, but legal precedence has been set that there is no evidence to support the idea that same-sex marriages are harmful to the state or its constituents.
Perhaps the next step in protecting families should be that bill to outlaw divorce.


*For those of you who aren't from California and don't pay attention to politics, back when Gavin Newsome was the mayor he set up a city convention where same-sex marriage was defined as perfectly legal. About 18.000 marriages were performed before the state came down and told him to please stop. Not, however, before a portion of the California populace was inflamed by the rising up of concentrated ungodliness and composed Proposition Eight which would forbid California from legalising their own or recognising other same-sex marriages. Prop Eight passed by a small margin, and was pretty much immediately taken to court over its constitutionality, especially concerning California's 'Equal Protection' clause of the constitution. This, nearly two years later, is the issue before the court.

Two women were able to get their forms completed, and were granted a marriage license before the stay was issued.

oops, turns out I was wrong. Or rather, they got paperwork and had a ceremony, but the city had said "no marriages until we know if there is a stay...and there is a stay."

Cautiously good news is that the stay is a temporary one (2 days) for the same judge to decide whether or not to make a longer-term one while the appeal process is ongoing.

Given the tenor I'd heard from his questions during the trial (as reported by that liberal rag, the San Jose Mercury), I could see him saying "F U" to the defense and letting the stay lapse. Good for him for doing due diligence.

I've been verklempt all afternoon since news broke, too.

My friends in Massachusetts would scold me if I did not note that Massachusetts has had legal gay marriage for years.
